Privacy Policy

This Privacy Policy explains how we (the developers of the Heart Rate Monitor – PulseGo app) collect, use, and disclose information when you use our Service, and informs you of your privacy rights. By using the App, you agree to the data practices described here.

Interpretation and Definitions

• You: the individual using the App. Under the GDPR, you are the data subject.

• Company (referred to as we or us): the developer of the Heart Rate Monitor – PulseGo application. We are the Data Controller under GDPR and the business under CCPA/CPRA.

• Application: the Heart Rate Monitor – PulseGo software on your device.

• Affiliate: an entity that controls or is controlled by us (with at least 50% ownership).

• Account: your user account in our Service.

• Service: the Application and any associated features.

• Service Provider: a third-party that processes data on our behalf (e.g. hosting, analytics, payment processors). They are “processors” under GDPR.

• Third-party Social Media Service: websites like Google or Facebook that let you log in or connect accounts.

• Personal Data: any information relating to an identified or identifiable person (e.g. name, email, ID number, location data). Under GDPR, this includes any factor specific to your physical, physiological, mental, economic, cultural or social identity. Under CCPA/CPRA, it includes any information that can be linked to you.

• Device: any device (computer, smartphone, etc.) you use to access the Service.

• Usage Data: automatically collected data about how you access or use the Service (for example, IP address, browser type, pages visited, time spent, device identifiers).

• Do Not Track (DNT): a browser setting that requests websites not track you. Under California law, websites must disclose how they respond to DNT signals[1].

• Business (CCPA): us, as the entity collecting your personal information and deciding how to use it.

• Consumer (CCPA): a California resident who uses our App.

• Sale (CCPA): any transfer of personal information to another party for value.

Data We Collect

While using our Service, we may collect the following categories of information:

• Contact and Account Information: When you register or create an account, we may collect personal data such as your name, email address, phone number, gender, and chosen password.

• Health and Wellness Data: If you choose to provide it (e.g. by manually entering or syncing via HealthKit/Google Fit), we may collect health metrics like your heart rate, weight, height, body temperature, menstrual cycle data, symptoms, calorie count, steps, or other health-related information. (This information may be imported from connected services like Apple HealthKit and Google Fit with your permission.)

• Usage and Diagnostic Data: We automatically collect data about your use of the App and device details. This may include your device’s IP address, operating system, app version, screen size, language and locale, device model, carrier information, time zone, and other technical or diagnostic information (such as unique device identifiers). For example, we collect the pages you visit in the app, the time and duration of those visits, and any crashes or error reports.

• Social Media Data: If you choose to log in or register using a third-party account (e.g. Google or Facebook), we may obtain basic profile information associated with that account (such as your name, email address, and profile picture), as well as any additional personal data that you permit us to access. We use this information only to facilitate your account creation and login and to personalize your experience.

We do not collect any data beyond what is necessary to operate the App and improve your experience. For example, we do not record audio, video, or other sensitive data unless you explicitly provide it (such as through health metrics). We will never collect your sensitive health data without your consent.

How We Use Your Data

We use the collected information for the following purposes:

• Provide and Improve the Service: We use your personal and usage data to operate the App’s core features (such as measuring and recording your heart rate), to maintain and troubleshoot the App, and to enhance and develop new features.

• Account Management: We use your registration information to manage your account and provide you with access to the Service.

• Support and Communication: We may use your contact information to send you service-related communications, such as security alerts, updates, or messages regarding your account or usage of the App. We may also use your information to respond to your requests and customer support inquiries.

• Marketing: With your consent (and where permitted by law), we may use your email or other contact details to send you promotional messages about new features, offers, or events related to the App. You can opt out of marketing communications at any time (for example, by following unsubscribe instructions in our emails).

• Contractual Obligations: We may use your data to fulfill our legal and contractual obligations, such as processing payments for in-app purchases or subscriptions.

• Legal Compliance and Safety: We process your data to comply with applicable laws and regulations, to protect our rights and the rights of other users, and to prevent fraud or misuse of the Service.

How We Share Your Data

We may share your personal information in the following situations:

• Service Providers: We work with third-party vendors who perform services on our behalf (such as analytics, crash reporting, cloud hosting, payment processing, email services, and marketing). These providers have access to your personal data only as needed to perform their functions and are contractually obligated to keep it secure and not use it for other purposes. For example, we use Google Analytics to monitor App usage trends, and the data it collects (device info, location, app usage) is only used by us to improve the App. You can opt out of Google Analytics on your device by adjusting your settings.

• Social Media and Sync Services: If you connect Apple HealthKit, Google Fit, or other health-related services, we may import data you’ve chosen to share (such as weight, heart rate, steps). We handle any such third-party data according to this Privacy Policy. Similarly, if you sign up via Google or Facebook, we receive only the information that those services permit us to access.

• Advertising and Cookies: Our App may display advertisements provided by third parties. These ad networks may use cookies or similar technologies to serve personalized ads based on your app usage and browsing activity. For example, Google AdSense and AdMob use the DoubleClick cookie to show you relevant ads on and off our App. You can opt out of interest-based ads by adjusting your device’s settings (e.g. “Opt-out of Ads Personalization” on Android or “Limit Ad Tracking” on iOS) or by visiting Google’s Ads Settings page. We do not share your personal health data with advertisers or any third parties for their use. All ad targeting is based on non-sensitive information collected via cookies and your device settings, not on your heart rate or other sensitive data.

• Business Transfers: If we undergo a merger, acquisition, or sale of all or a portion of our assets, your personal data may be transferred to the new owner. We will notify you before any such transfer and ensure the new entity is bound by this Privacy Policy.

• Affiliates and Partners: We may share your information with our parent company, subsidiaries, or partners who work with us on joint services. They are required to follow this Privacy Policy. We may also share information with business partners when offering co-branded services or promotions, but only with your consent where required by law.

• Other Users: If you post content in a public area of the App (such as community forums or leaderboards), that information may be visible to other users. Similarly, if you use a social login or share content with your contacts, your friends or followers may see your name, photo, and activity. We recommend exercising caution and using the App’s privacy settings if you wish to limit what you share publicly.

• Legal and Safety Reasons: We may disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g. to comply with a court order or legal process). We may also disclose data when we believe it is necessary to investigate fraud, security breaches, or other wrongdoing, or to protect the rights, property or safety of ourselves, our users, or the public.

Retention and Security

• Data Retention: We retain your Personal Data only as long as necessary to fulfill the purposes outlined in this policy, or as required by law. For example, if you close your account, we may retain certain information to comply with legal obligations or resolve disputes. Usage Data (analytics and logs) is generally kept for a shorter period, unless we need it for security or compliance reasons.

• Data Transfer: Your information may be processed on servers located outside your country (we have operations and service providers in multiple countries). We will ensure that any transfers of your personal data to other countries comply with applicable data protection laws (for example, by relying on countries recognized as having adequate protections or by using contractual safeguards). By using our Service, you consent to such transfers.

• Security Measures: We implement technical and organizational measures to protect your data, such as encryption (SSL/TLS) during transmission, firewalls, data encryption at rest, access controls, and regular security assessments (vulnerability scans and penetration tests). We also enforce strict internal policies and limit data access to authorized personnel. However, no internet transmission or storage can be guaranteed 100% secure. We strive to protect your data, but we cannot guarantee its absolute security.

Analytics, Cookies, and Tracking

• Analytics Tools: We use analytics services (such as Google Analytics) to better understand how users interact with our App. These tools collect certain information (device type, IP address, screen size, app usage) but do not collect your personal health information. You can disable analytics tracking by adjusting your device settings.

• Cookies (Webview Browsers): If the App includes any web-based content (e.g. forums or embedded web pages), cookies may be used to manage those features, keep you logged in, and improve performance. You can usually control cookies through your web browser settings. Disabling cookies may cause some parts of the App to not function properly.

• Advertising and Remarketing: We and our third-party vendors may use remarketing services (such as Google Ads, Facebook, and Twitter advertising networks) to advertise to you on other websites after you have visited our App. These services use cookies or similar technologies to track your visit and serve targeted ads. You can opt-out of Google’s interest-based ads by adjusting your settings at Google Ads Settings or installing the Google Analytics opt-out browser add-on. For Facebook, you can opt-out at Facebook Ad Settings, and for Twitter at Twitter Ad Settings. You can also visit YourAdChoices for broader opt-out. Remember that any opt-out applies only to the specific browser or device you use.

• No Sale of Personal Data: We do not sell your personal information (as defined under CCPA/CPRA). Any sharing with service providers and partners is for business purposes only and not a “sale.” You may choose to opt-out of targeted advertising as described above.

Payments

If you make purchases (e.g. a premium subscription) through the App, payments are processed by trusted third-party platforms. We do not store your payment card details. The transaction and payment information you provide (such as credit card number, billing address) is transmitted directly to payment processors (like Apple Store In-App Purchase, Google Play Billing, PayPal/Braintree, WeChat Pay, Alipay, etc.) and is handled in accordance with their privacy policies and PCI-DSS security standards. We do not retain full payment details. You should review the privacy policies of those payment providers for more information.

Your Rights (GDPR and CCPA/CPRA)

GDPR (EU/EEA/UK Residents): If you are located in the European Economic Area or UK, you have the following rights under the GDPR: the right to access your data, rectify inaccurate or incomplete data, erase your data (the “right to be forgotten”), restrict or object to processing, and port your data to another service. You also have the right to withdraw consent at any time if we process your data based on consent. We respect these rights and will respond to verifiable requests. For example, you may ask us for a copy of the personal data we hold about you (in a machine-readable format) or request that we delete it if it is no longer needed (except where we must retain it for legal reasons). We will provide information about how to exercise these rights in a clear and timely manner[2][3]. You also have the right to lodge a complaint with a data protection authority in your jurisdiction if you believe your rights have been violated.

CCPA/CPRA (California Residents): If you are a California resident, you have the rights under the California Consumer Privacy Act (as amended by the California Privacy Rights Act). These include:
Right to Know: You can request information about what categories of personal data we collect, the sources of that data, the purposes for collection, and the categories of third parties with whom we share data.
Right to Delete: You can request deletion of the personal data we have collected from you in the past 12 months, subject to certain exceptions.
Right to Opt-Out: You can opt out of any sale or sharing of your personal data. (We do not sell personal data, but this right applies if any such activity were to occur.)
Right to Correct: You have the right to request correction of inaccurate personal data we hold about you[4].
Right to Limit: You have the right to request limitations on the use or disclosure of sensitive personal information we have collected about you[4].
Right to Non-Discrimination: You cannot be discriminated against (e.g. charged different rates or denied services) for exercising your California privacy rights.

We will verify your request and provide the required information free of charge (within 45 days, with a possible one-time 45-day extension if needed). You may also designate an authorized agent to make requests on your behalf.

Do Not Sell / Do Not Track: Our Service does not sell your personal information as defined by California law. We honor “Do Not Sell My Personal Information” requests via our cookie consent tools or a dedicated opt-out page. We do not respond to browser “Do Not Track” signals, as the industry standards for DNT are not yet established[1]. If you enable DNT in your browser, it will not change our data practices.

Children’s Privacy

Our Service is not intended for children under 13. We do not knowingly collect personal data from anyone under 13. If we learn that a child under 13 has provided us with personal information, we will delete such information as soon as possible. If you are a parent or guardian and become aware that your child under 13 has used our Service, please contact us so we can take appropriate action.

California Minors

California law (Business & Professions Code §22581) allows minors (under 18) who are registered users to request removal of content or information they have publicly posted[5]. If you are a California resident under 18 and want to remove personal content you posted to the App, contact us with your request and the email associated with your account. We will respond in accordance with the law. Note that the law may not guarantee complete removal in all cases, and content shared by others may remain.

Links to Other Websites

Our Service may contain links to third-party websites or services not owned or controlled by us. We are not responsible for their content or privacy practices. We strongly encourage you to read the privacy policies of any third-party sites you visit.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time (for example, when we add new features or in response to legal changes). We will post the revised Privacy Policy in the App and update the “Last updated” date. If we make material changes, we will provide notice (e.g. via email or in-app notification). Please review this policy periodically.
